1. General Terms and Conditions of Purchase
1.1 These terms and conditions of purchase apply when you as a consumer/customer place orders from Hamphi AB, company registration number 559197-3747, on Hamphi.com. These terms and conditions are only applicable to you as a customer/consumer making orders via Hamphi.com.
1.2 When placing orders on Hamphi.com, a purchase agreement is entered into between you and Hamphi AB. Please note that there is no binding purchase agreement with Hamphi AB until you have received a receipt copy or invoice for your delivery. Your order confirmation is not a valid receipt. The agreement is entered into in Swedish. Purchase agreements are archived and kept available to the customer. In order to make a purchase, you must accept these terms and conditions of purchase. By completing a purchase, you accept Hamphi AB’s terms and conditions of purchase on Hamphi.com and undertake to comply with them in full.
1.3 In order to place an order on Hamphi.com, you as the customer must be at least 18 years old, as under Swedish law we do not accept credit purchases from persons under 18 years of age. If you are under 18, guardian consent is required before ordering. We reserve the right, under certain circumstances, to change or reject an order (for example if the customer has provided incorrect personal details).
1.4 We reserve the right for items being sold out as well as for any typographical and image errors. Examples include errors in product descriptions, product technical specifications, ingredient/content lists, instructions for use, incorrect prices, or incorrect information regarding whether an item is in stock. This also includes incorrect prices arising from manual handling errors or technical errors. Hamphi.com has the right to correct any inaccuracies and to change the information at any time. All images should primarily be regarded as illustrations and can therefore not be guaranteed to exactly reproduce the actual appearance of the item.
1.5 Hamphi.com as a store and website is owned by Hamphi AB. The content on the website is owned by Hamphi AB, our partners, or their licensors.
1.6 When you place your order with us, you provide your personal data. In connection with your registration and order, you agree that we store and use your information in our business in order to fulfill the agreement with you. Under personal data legislation, you have the right to obtain the information we have registered about you. If it is incorrect, incomplete, or irrelevant, you may request that the information be corrected or deleted. In that case, please contact us by email at [email protected].
1.7 We reserve the right to change prices without prior notice, for example in the event of major changes in exchange rates. Stocked products are always delivered at the confirmed price, and if the price of a stocked product changes between order and delivery, the price stated in the order confirmation applies. For products that are not available in stock at the time the order is placed, the order-confirmed price applies subject to price adjustments from the supplier or other circumstances beyond Hamphi AB’s control. If a new price must be offered for the order, this must be approved by the customer; otherwise the order will be canceled. We reserve the right for any inaccuracies and changes beyond our control. We reserve the right to cancel an order if incorrect prices are stated on the website, as these are automatically registered. The overview is a copy of your shopping cart and not our acceptance or confirmation of the order.
2. Prices and Payment
2.1 When ordering on Hamphi.com, the prices stated on the website at the time of ordering apply for each respective country. Our prices on Hamphi.com (the main domain) are stated in Swedish kronor, but you have the option to choose to view prices in your local currency. If you are located outside the EU, your local VAT and customs duties will be added to the goods; within the EU, all taxes and customs duties are included. Prices do not include any shipping fees or payment fees, which are stated separately in a clear manner before the customer completes the order.
2.2 As a customer, you may choose to display prices including VAT or excluding VAT (for example for business customers, customers in Norway, and Åland).
2.3 Svea - Business Invoice
Credit assessment: When applying for payment via business invoice, a customary credit assessment is carried out, which may mean that a credit report is obtained.
Payment terms: The due date and other terms for business invoices are stated on the invoice. For invoice payments, payment must have been received no later than 30 days from the invoice date. In the event of late payment, a reminder fee of SEK 60 and default interest of 2% per month from the due date until full payment is made will apply.
Assignment: All business invoices will be assigned to Svea Bank AB, 556158-7634 (“Svea Bank”). All payments relating to the invoice shall be made to Svea Bank.
GDPR: When paying via business invoice, the invoice will be assigned to Svea Bank AB and we will then share the business customer’s personal data with Svea Bank. Svea Bank is the data controller for the claims that we have assigned to Svea Bank. 3. Campaigns and Offers
3.1 Hamphi.com may, during certain periods and under certain circumstances, offer campaigns that provide more favorable prices or terms than those stated in these terms and conditions of purchase. Such more favorable terms apply for as long as the campaign or offer is active and apply to the specific items covered by the campaign or offer. We reserve the right to withdraw these at any time. Upon the end or withdrawal of a campaign or offer, these terms and conditions of purchase apply without changes. Offers on specific products apply for a limited time and/or while stocks last.
4. Delivery and Transportation
4.1 Hamphi.com delivers within Europe and to the rest of the world; for more information, contact us at [email protected] or see which countries we deliver to at checkout.
4.2 Orders received before 13:00 are usually shipped the same day. Delivery time thereafter is 1–5 business days depending on the shipping method and the recipient country. Unfortunately, we cannot affect any delays caused by the carrier. In the event of such delivery delays, we will continue to monitor the order.
4.3 Please check that the delivery details such as name, address, and phone number are correct before completing your purchase. Unfortunately, these details cannot be changed after the order has been packed at our warehouse.
4.4 If the parcel is to be collected from a pickup point, the customer will receive a notification stating where and when the parcel is to be collected. In that case, the customer must collect the parcel within the time stated in the notification, which depends on the shipping option you choose. Notification may be sent by email, SMS, or regular mail. Normally, parcels must be collected in person with the parcel ID and valid identification. If you have lost the parcel ID or have questions regarding collection, please email us at [email protected].
4.5 Made-to-order items or items that are out of stock have a longer delivery time. For goods from European suppliers, delivery time is usually 1–2 weeks. For goods manufactured outside Europe, delivery time is usually 2–4 weeks. See the current stock balance under each product on the website. We reserve the right for typographical errors and incorrect stock balances. For questions regarding delivery time and the current delivery time for goods, please contact customer service at [email protected]. Please note that ordering products that are made-to-order items may in many cases involve shipping from an external warehouse and external suppliers. If you wish to make a return or cancel your order due to long delivery time, you must return your parcel after you have received it. Parcels are shipped automatically as all shipments are booked when the order is placed, so you as the customer must collect the parcels from your pickup point and then contact us to complete a return.
4.6 Hamphi AB reserves the right, free of charge and without stating a reason to you, to upgrade your shipping and delivery method for your order. This may be due to changes in the terms of certain carriers we use, and may also be due to inaccuracies in our shipping system causing incorrect carriers or shipping services to be presented to you at the time of ordering.
4.7 In the event of refused delivery, a fee of SEK 1,000 (incl. VAT) will be charged to cover the carrier’s handling as well as any costs associated with the delivery. The same fee may also be charged if you later wish to change the delivery address. Please note that an address change is not always possible depending on the selected shipping method. For larger deliveries, the carrier may charge storage fees if the recipient cannot be reached via the phone number or email provided in order to schedule delivery. You are responsible for ensuring that the contact details are correct and that delivery can be booked. Storage fees are charged from day 4 after the shipment has arrived at the terminal. These costs will be invoiced to you as the customer. Please note that the storage fee does not include any return costs or other additional fees.
The storage fees charged are:
1–29 kg: SEK 140 per shipment per day (incl. VAT).
30–99 kg: SEK 180 per shipment per day (incl. VAT).
4.8 Particularly large shipments such as roof boxes, rear boxes, bike racks, and other bulky products delivered by home delivery are not covered by free shipping over SEK 1,000. The shipping cost for these goods is shown at checkout and varies depending on the destination you choose for your parcel.
5. Right of Withdrawal.
5.1 We offer a 14-day right of return to you as a private individual (not a business). The right of withdrawal applies to products that are not uniquely linked to specific vehicles through special orders or to products with a personal/customized character. If you regret your purchase within this period, it is important that you contact us at [email protected] and state that you wish to make a return and which parts of your order you wish to return. You will then be given access to our returns portal where you can obtain a shipping label to return your order. You will also receive a personal return slip which must be enclosed in the parcel. After 14 days, we offer store credit for your return for up to 31 days (excluding Maxton Design products); any return costs will be deducted from your store credit.
5.2 You as the customer are responsible for the return shipping cost back to us. Return costs are divided into different levels depending on the size of the shipment you are returning. Please note that you are responsible for the shipment until it arrives with us, so pack it securely!
Return shipping prices - Sweden
Parcels under 1 kg in volumetric weight: SEK 50
Parcels between 1–3 kg in volumetric weight: SEK 100
Parcels between 3–50 kg in volumetric weight: SEK 200
A parcel with one side exceeding 120 cm but not exceeding 150 cm: SEK 300
Parcels with one side exceeding 150 cm but not exceeding 180 cm: SEK 1,500
Parcels with one side exceeding 180 cm, 50 kg in volumetric weight, or where length + girth exceeds 300 cm must be returned by you yourself in consultation with us. If you refuse delivery of a parcel of this size, a fixed return cost of SEK 3,000 applies.
Return shipping prices - Denmark
Parcels under 3 kg in volumetric weight: DKK 150
Parcels between 3–50 kg in volumetric weight: DKK 200
A parcel with one side exceeding 120 cm but not exceeding 150 cm: DKK 300
Parcels with one side exceeding 150 cm, 50 kg in volumetric weight, or where length + girth exceeds 300 cm must be returned by you yourself in consultation with us.
Return shipping prices - Finland and other EU countries
Parcels under 3 kg in volumetric weight: EUR 20
Parcels between 3–50 kg in volumetric weight: EUR 30
A parcel with one side exceeding 120 cm but not exceeding 150 cm: EUR 40
Parcels with one side exceeding 150 cm, 50 kg in volumetric weight, or where length + girth exceeds 300 cm must be returned by you yourself in consultation with us.
How is volumetric weight calculated?
In some cases, volume is converted into weight. A parcel may be light but still require significant resources in terms of handling. For that reason, we convert volume into weight by equating each cubic meter with 280 kg.
Example of how volumetric weight is calculated:
A parcel with dimensions 0.5 × 0.5 × 0.5 m has a volume of 0.125 m³. To calculate the volumetric weight, the volume is multiplied by 280 kg (0.125 × 280, which equals 35 kg). If the actual weight of the parcel in this example were 18 kg, you would pay the shipping price for 35 kg (i.e. the higher of the actual weight or the volumetric weight).
In the example above, the return would have cost SEK 200, since the volumetric weight is between 3–50 kg and no individual side of the parcel exceeds 120 cm.
Please note that you are responsible for the shipment until it arrives with us, so pack it securely!
5.3 All goods must be returned in the original packaging without damage. Tape and shipping labels may only be attached to the outer packaging. A return slip from the return portal must be enclosed. If the return slip is not completed correctly, the return slip is missing from the parcel, or if any of the other criteria above are not met, we reserve the right to make a deduction of 20% of the product’s value. From the time you receive the shipping label for your return, the parcel must be handed in at a pickup point within 14 days, otherwise the return will not be approved.
5.4 Returns may not be sent cash on delivery or to a pickup point, and parcels may not be sent directly to our company address. Returns must go through our system to ensure tracking and proper handling in our systems. If these terms are not met, the return will not be approved. Orders placed via Hamphi.com (e-commerce) cannot be returned in a physical store. All returns of e-commerce orders must be sent back in accordance with the instructions in Hamphi AB’s return process. This is because the store and e-commerce operations are handled in separate systems and logistics flows, which means that the store cannot receive or administer returns of web orders.
5.5 For orders from North American suppliers or Maxton Design, the right of withdrawal applies (with the exception of special orders), but the goods must not be sent back to us. You are responsible for the shipping back to the manufacturer yourself. Examples of North American suppliers include Unplugged Performance, T-sportline, and Rally Armour.
Please note that shipping costs for this are often very high. We can arrange shipping labels within Europe for returns to Maxton Design according to the following price list:
Parcels with one side not exceeding 120 cm: SEK 1,000
Parcels with one side exceeding 120 cm but not 150 cm: SEK 1,500
Parcels with one side exceeding 150 cm but not 180 cm: SEK 2,000
Parcels with one side exceeding 180 cm but not 200 cm: SEK 2,500
Parcels with one side exceeding 200 cm but not 300 cm: SEK 3,000
Orders for Maxton Design cannot be canceled after the order has been placed. If the customer no longer wants the product after ordering, the delivery must first be accepted and then returned according to the applicable 14-day return terms, or the customer may refuse the delivery at the time of delivery in accordance with the applicable terms and conditions of purchase.
5.6 Tesla genuine spare parts are ordered using a specified VIN number and are therefore custom-adapted. No right of withdrawal applies. Always check that the VIN number is correct before ordering. Returns are only approved in the event of incorrect delivery or a defective item, in accordance with our return policy.
5.7 If the order is placed using company details (for example company name or organization number), it is considered a business order. The right of return then does not apply. If a return is refused, return shipping will be charged as above. If you want the goods sent back to you, a new shipping cost will apply, which will be invoiced and must be paid before dispatch.
5.8 Tires are not considered parcels and require special delivery. In the event of a tire return, a return cost of SEK 500 per returned tire will be charged.
5.9 For purchases from Norway & the United Kingdom, the right of withdrawal applies in accordance with consumer protection legislation (Consumer Contracts Regulations). The customer has the right to cancel their purchase within 14 days from receipt of the goods, except for products that are exempt from the right of withdrawal under law or these terms and conditions of purchase (for example special orders).
The customer must always contact Hamphi AB in advance to report the return and obtain an approved reference or case number before the return is sent. Returns sent without a valid reference number may be refused.
In the event of returns from Norway or the United Kingdom, the customer is responsible for:
- return shipping
- customs duties, import VAT, and local taxes
- handling and administration fees from transport companies
Hamphi AB does not act as importer or customs representative. Returns must be sent with tracking and correctly marked as “Return of goods”. Any costs incurred by Hamphi AB due to incorrect labeling, refused delivery, or unpaid customs duties will be invoiced to the customer or deducted from any refund.
For purchases from countries outside the EU and the United Kingdom, no statutory right of withdrawal applies. Returns from these countries are accepted only after express approval from Hamphi AB.
The customer must always contact Hamphi AB in advance to apply for a return and obtain an approved reference or case number before the return is sent. Returns sent without prior approval or without a valid reference number may be refused.
For approved returns, the customer is responsible for all costs, including but not limited to:
- return shipping
- customs duties
- import VAT and taxes
- handling and administration fees from transport companies
Hamphi AB does not act as importer, customs representative, or tax representative. Costs charged to Hamphi AB in connection with a return will be invoiced to the customer or deducted from any refund.
Hamphi AB reserves the right to fully or partially refuse returns from countries outside the EU.
6. Refunds
6.1 If you have exercised your right of withdrawal and it has been approved, we shall refund what you have paid for the item as soon as possible and no later than within 30 days from the day we received the item. We do not refund the shipping cost in your original purchase if you have paid for this, as it is a shipping service that has been consumed. The same applies to express handling, as this service is consumed.
6.2 In the event of a canceled order, the shipping cost in your order will be refunded as long as it has not been consumed and booked. Express handling is refunded only if order processing has not yet started in the warehouse; after that, the service is considered consumed and no refund will be made.
6.3 In the event of an incorrectly handled Klarna refund, we have the right to charge you as the customer SEK 200 (incl. VAT) as an administration fee. This cost is originally charged by Klarna and we then pass it on to you as the customer. Applies when you have approved a longer delivery time for orders and then create a case with Klarna for a refund.
7. Complaints
7.1 Please contact customer service at [email protected] before sending back an item, regardless of the reason, for instructions and the fastest possible handling. Under the Swedish Consumer Sales Act, you have the right to complain about your purchase to us within a reasonable time (however no more than three years). If you wish to make a complaint about a product, you must do so within a reasonable time after you noticed or should have noticed the defect by contacting us. The defect must normally be an original defect and not caused by incorrect use/handling of the item. Complaints made within two months from the time you discovered the defect are always considered to have been made in time.
7.2 To report that an item you ordered from us is defective, we recommend that you contact us by email at [email protected]. Do not forget to include information such as order number and product number/product name. Describe the defect carefully for the fastest possible handling and attach pictures of the defect.
7.3 In many cases, we will need to have the item returned in order to handle the complaint. In such cases, we recommend that you send the goods in a trackable and insured manner, as you as the sender are responsible for ensuring that the goods reach us. Normally, the customer initially pays the return shipping cost. If the complaint is approved, the customer is always reimbursed for the return shipping cost. We only cover the shipping for approved complaints.
7.4 You as a customer or business must report damaged parcels and products on the same day as delivery, so that you can make a complaint with the carrier. Hamphi AB does not accept responsibility for warranties that customers lose on their vehicles when installing various products sold on Hamphi.com. Installation is carried out at your own risk.
7.5 In the event of an approved complaint, we will send out new products. If the products are out of stock, we may offer you equivalent products. Even though we try as far as possible to offer the same products again, this is not always possible. In connection with receiving the new products, you will also receive a return label that you can attach to the same parcel to send the defective products back to us. If you choose not to return the defective products, the complaint will not be approved in full and we will charge you for the new replacement products we send out as well as the shipping for these.
8. Uncollected Parcels
8.1 In connection with uncollected parcels, a number of costs arise from shipping companies that we are forced to pay. We therefore charge a fee of SEK 100 for uncollected parcels in addition to the return shipping cost. The cost will be deducted from any refund.
This cost is charged together with the return shipping cost for the goods depending on their volumetric weight and actual weight. The cost is intended to cover part of our increased costs from the carriers due to you not collecting the parcel you ordered, i.e. the handling and administration for the carrier to begin processing a return. Return shipping is charged according to the price list above.
This also applies if you as the customer have entered an incorrect phone number in your order, meaning you did not receive the SMS correctly regarding collection of your parcel. In that case, it is your responsibility as the customer to contact us or the carrier regarding your order before the parcel is returned to us. The amount for the uncollected parcel together with return shipping will be deducted from your refund for the order. If the refund amount for the order does not cover this cost, the remaining part will be invoiced externally. If you regret your purchase and do not want to pay this fee, you must collect the parcel and then return it to us according to the information under Right of Withdrawal.
8.2 Parcels that are to be collected from a pickup point remain there for up to 14 days (depending on your choice of shipping provider at checkout) before they are returned to us. For larger shipments sent on a half or full pallet to your business or home address (usually tires, rims, etc.), special terms apply; see section 4.7.
8.3 Changes to existing deliveries after the parcel has left our warehouse are subject to a fee of SEK 300 and will be invoiced afterwards.
8.4 If pickup in store (Borås) is selected, the customer is responsible for collecting the order within 30 days from the date the order is marked as ready for pickup and the customer has been notified by email (it is the customer’s responsibility to ensure that the email is delivered).
If the order is not collected within this period, Hamphi AB reserves the right to charge an administration fee of SEK 100 to cover costs for administration, storage, and handling.
If the customer wishes to cancel an order that has not been collected, and the order at the time of cancellation has already been picked and packed for pickup, Hamphi AB reserves the right to charge an administration fee of SEK 100. Any refund will be made after deduction of the applicable fee.
9. Disputes
9.1 We strive to resolve all matters in agreement with the customer before a dispute arises so that you as the customer feel satisfied with your purchase. If you have a complaint or claim against us, we are happy to receive it via our customer service. In such cases, please send an email to [email protected].
9.2 Any dispute concerning the application or interpretation of these terms and conditions of purchase shall be interpreted in accordance with Swedish law and be decided by the National Board for Consumer Disputes (Allmänna Reklamationsnämnden), or ultimately by a general court.
10. Changes to the Terms and Conditions of Purchase
10.1 Hamphi reserves the right to make changes to the terms and conditions of purchase. Changes to the terms and conditions of purchase will be announced on Hamphi.com. The terms applicable from time to time are available at Hamphi - terms and conditions of purchase
11. Links
11.1 Hamphi.com and Hamphi AB may link to other websites outside our control and vice versa. Although we aim to ensure that we only link to such websites that share our policies, Hamphi AB is not responsible for the protection, privacy, or information including personal data that the customer provides on other websites. We recommend that the customer reads the privacy policy of the relevant website.
12. Installation
12.1 Products installed by you as the customer or at our workshop are not covered by open purchase, as the goods are no longer in new condition after installation.
12.2 If you as the customer or another third party choose to remove installed products and other technical solutions installed by Hamphi AB, Hamphi AB reserves the right not to reinstall certain parts if they are considered damaged or broken due to having been incorrectly removed from the vehicle. In such cases, you will be offered spare parts/replacement products at a discounted price to replace the broken parts. If you as the customer or another third party have chosen to remove one or more products that Hamphi AB has installed at the customer’s request, we reserve the right to charge you as the customer if you wish to have the equipment or products reinstalled.
12.3 Hamphi AB is not responsible for damage that may occur to your or others’ vehicles when you install any of our products on your own initiative. Any costs related to installation, incorrect installation, or damage caused by incorrect installation are the customer’s own responsibility.
12.4 Cars brought into Hamphi AB’s workshop are insured against damage that may arise in connection with the installation of various products. For applicable insurance and terms with our respective resellers, we recommend that you contact them directly.
12.5 In the event of complete cancellation of a workshop appointment, 10% of the order value will be charged as an administrative fee. This is to cover the administrative costs that arise in connection with canceling your workshop order and changes to prepared products for your installation.
13. Resellers/Partners
13.1 Products from Hamphi.com that are sold and/or installed by approved resellers of Hamphi AB are covered by the same warranty and service as we at Hamphi.com offer you. Please note that installed goods are not covered by open purchase, as the goods are no longer in new condition after installation and the packaging has been recycled.
13.2 For the right of withdrawal with our respective resellers, we recommend that you contact them directly for the applicable terms.
13.3 Hamphi AB offers a partner portal for approved partners. Purchases, commissions, and other terms relating to partner operations are governed by separate partner agreements and partner terms, which are provided in the partner flow. In the event of any deviations between these terms and conditions of purchase and the partner agreement, the partner agreement shall apply to partner-related purchases and transactions.
14. Cancellation of Rental Agreements
14.1 In the event of cancellation of booked equipment, the lessor has the right to charge compensation as follows:
– 10% of the rental cost for cancellations made more than 30 days before the start of the rental period.
– 50% of the rental cost for cancellations made within 30 days but more than 7 days before the start of the rental period.
– 100% of the rental cost for cancellations made within 7 days before the start of the rental period.
Other
We reserve the right for any typographical errors and changes to technical data that are beyond our control. We reserve the right to change prices on products without prior notice.
