1. General Terms and Conditions

1.1 These terms and conditions apply when you as a consumer/customer place orders from Hamphi AB, organization number 559197-3747, at Hamphi.com. These terms and conditions are only applicable to you as a customer/consumer making orders via Hamphi.com

1.2 When placing orders at Hamphi.com, a purchase agreement is entered into between you and Hamphi AB. Please note that there is no binding purchase agreement with Hamphi AB until you have received a receipt copy or invoice for your delivery. Your order confirmation is not a valid receipt. The agreement is entered into in Swedish. Purchase agreements are archived and kept available to the customer. To make a purchase, you must accept these terms and conditions. By completing a purchase, you approve Hamphi AB's terms and conditions at Hamphi.com and commit to following the terms and conditions in their entirety.

1.3 To be able to order at Hamphi.com, you as a customer must be 18 years old, as according to Swedish law we do not accept credit purchases to persons under 18 years. If you are under 18 years, guardian consent is required before ordering. We reserve the right to change or reject an order under certain circumstances (e.g., if the customer has provided incorrect personal information).

1.4 We reserve the right for final sale and any typographical and image errors. Examples of this include errors in product description, product technical specifications, content lists, instructions for use, incorrect prices, or incorrect information regarding whether an item is in stock. This also includes incorrect prices that arise as a result of manual handling errors or technical errors. Hamphi.com has the right to adjust any errors and to change the information at any time. All images should primarily be perceived as illustrations and therefore cannot be guaranteed to accurately reproduce the exact appearance of the item.

1.5 Hamphi.com as a store and website is owned by Hamphi AB. The content on the website is owned by Hamphi AB, our partners, or their licensors.

1.6 When placing your order with us, you provide your personal information. In connection with your registration and order, you approve that we store and use your information in our business to fulfill the agreement with you. According to the Personal Data Act, you have the right to receive the information we have registered about you. If it is incorrect, incomplete, or irrelevant, you can request that the information be corrected or deleted. In that case, contact us via email at [email protected]

1.7 We reserve the right to change prices without prior notice, e.g., in case of major changes in exchange rates. Stocked products are always delivered at the confirmed price, and if the price for a stocked product changes between order and delivery, the price stated in the order confirmation applies. For products that are not available in stock at the time of ordering, the order-confirmed price applies with reservation for price adjustments from suppliers or other circumstances beyond Hamphi AB's control. If a new price can be offered on the order, this must be approved by the customer, otherwise the order will be canceled. We reserve the right for any errors and changes beyond our control. We reserve the right to cancel an order if incorrect prices are stated on the website, as they are automatically registered. The overview is a copy of your shopping cart and not our acceptance or confirmation of the order.

2. Prices and Payment

2.1 When ordering at Hamphi.com, the prices stated on the website at the time of order apply for the respective country. Our prices at Hamphi.com (the main domain) are stated in Swedish kronor, you have the option to choose to see prices in your local currency. If you are located outside the EU, your local VAT on goods and customs will be added, within the EU all taxes and customs fees are included. Prices do not include any shipping fees and payment fees which are stated separately in a clear manner before the customer completes the order.

2.2 You as a customer have the option to display prices including VAT or excluding VAT (business customers, customers in Norway and Åland as examples).

2.3 Svea - Business Invoice

Credit check: When applying for payment via business invoice, a standard credit check is performed, which may involve obtaining a credit report.

Payment terms: Due date and other terms for business invoice are stated on the invoice. For invoice payment, payment must be received no later than 30 days from the invoice date. In case of payment delay, a reminder fee of 60 SEK and late interest of 2% per month from the due date until full payment is made will be added.

Assignment: All business invoices will be transferred to Svea Bank AB, 556158-7634 ("Svea Bank"). All payments related to the invoice shall be paid to Svea Bank.

GDPR: When paying via business invoice, the invoice will be transferred to Svea Bank AB and we will then share the business customer's personal data with Svea Bank. Svea Bank is the data controller for the claims we have transferred to Svea Bank. 3 Campaigns and Offers

3.1 Hamphi.com may during certain periods and circumstances offer campaigns that may have more favorable prices or terms than those stated in these terms and conditions. Such more favorable terms apply for as long as the campaign or offer lasts and cover the specific goods covered by the campaign or offer. We reserve the right to withdraw these at any time. Upon termination or withdrawal of a campaign or offer, these terms and conditions apply without changes. Offers on specific products apply for a limited time and/or while stocks last.

4. Delivery and Transport

4.1 Hamphi.com delivers in Europe and to the rest of the world, for more information contact us at [email protected] or see which countries we deliver to at checkout.

4.2 Orders received before 1:00 PM are usually shipped the same day. The delivery time is thereafter 1-5 working days depending on shipping method and recipient country. Unfortunately, we cannot influence any delays at the shipping company. In case of such delivery delays, we continue to monitor the order.

4.3 Please check that the delivery information such as name, address, and phone number are correct before completing the purchase. Unfortunately, it is not possible to change this information after the order has been packed at our warehouse.

4.4 If the package is to be picked up at an agent, the customer will receive a notification describing where and when the package should be picked up. In that case, the customer must pick up the package within the time specified in the notification, which depends on the shipping option you choose. Notification may be sent via email, SMS, or regular mail. Normally, packages must be collected personally with package ID and valid identification. If you have lost the package ID or have questions about the pickup, please email us at [email protected]

4.5 Order items or items that are out of stock have a longer delivery time. For items from European suppliers, this delivery time is usually 1-2 weeks. For items manufactured outside Europe, the delivery time is usually 2-4 weeks. See current stock status under the respective product on the website. We reserve the right for typographical errors and incorrect stock balances. For questions about delivery time and current delivery time for goods, please contact customer service at [email protected]. Please note that ordering products that are order items can in many cases mean shipping from external warehouses and external suppliers. If you wish to make a return or cancel your order due to long delivery time, you must return your package after receiving it. Packages are automatically sent out as all shipments are booked at the time of order, so you as a customer must pick up the packages at your agent and then contact us to complete a return.

4.6 Hamphi AB reserves the right to upgrade your shipping and delivery method for your order free of charge and without stating a reason to you. This may be due to changes in terms with certain shipping companies we use, it may also be due to errors in our shipping system where incorrect shipping companies or shipping services are presented to you when ordering.

4.7 In case of refused delivery, an additional fee of 1000 SEK (incl. VAT) will be charged to cover the shipping company's handling and any storage fees. We also charge this cost in cases where you wish to change the delivery address afterwards (depending on shipping method, it is not always certain that it can be done). For changes to larger deliveries, a storage fee may also be charged by the shipping companies, this is invoiced directly to you as a company or individual. The cost is added to any return costs.

4.8 Particularly large shipments such as roof boxes, rear boxes, bike racks, and other bulky products delivered with home delivery are not covered by free shipping over 1000 SEK. The shipping cost for these items is shown at checkout and varies depending on the selected destination for your package.

5. Right of Withdrawal.

5.1 We offer a 14-day open purchase to you as a private person (not companies). The right of withdrawal applies to products that are not uniquely linked to specific cars according to special orders or to products with a personal touch. If you regret your purchase within this period, it is important that you contact us at [email protected] and state that you want to make a return and which parts of your order you want to return. You will then get access to our return portal where you can obtain a shipping label to return your order. You will also receive a personal return slip that must be included in the package. After 14 days, we offer a credit on your return for up to 31 days (not Maxton Design products), any return costs will be deducted from your credit.

5.2 You as a customer are responsible for the return cost back to us, the return cost is divided into different levels depending on the size of the shipment you return. Keep in mind that you are responsible for the shipment until it arrives at us, so pack well protected!

Package under 3 kg in volumetric weight: 100 SEK
Package between 3-50 kg in volumetric weight: 200 SEK
Package has one side exceeding 120 cm but not over 150 cm: 300 SEK
Package has one side exceeding 150 cm but not over 180 cm: 1,500 SEK
Package has one side exceeding 180 cm, 50 kg in volumetric weight, or where length + circumference exceeds 300 cm, you need to arrange return shipping yourself in consultation with us.

Shipping prices for returns - Denmark
Package under 3 kg in volumetric weight: 150 DKK
Package between 3-50 kg in volumetric weight: 200 DKK
Package has one side exceeding 120 cm but not over 150 cm: 300 DKK
Package has one side exceeding 150 cm, 50 kg in volumetric weight, or where length + circumference exceeds 300 cm, you need to arrange return shipping yourself in consultation with us.

Shipping prices for returns - Finland and other EU countries
Package under 3 kg in volumetric weight: 20 EUR
Package between 3-50 kg in volumetric weight: 30 EUR
Package has one side exceeding 120 cm but not over 150 cm: 40 EUR
Package has one side exceeding 150 cm, 50 kg in volumetric weight, or where length + circumference exceeds 300 cm, you need to arrange return shipping yourself in consultation with us.

How is volumetric weight calculated?
In some cases, volume is converted to weight. A package can be light but at the same time require large resources in terms of handling. For this reason, we convert volume to weight by equating each cubic meter with 280 kg.

Example of how volumetric weight is calculated:
A package with dimensions 0.5 × 0.5 × 0.5 m has a volume of 0.125 m³. To calculate the volumetric weight, the volume is multiplied by 280 kg (0.125 × 280 which equals 35 kg). If the actual weight of the package in this example were 18 kg, you pay the shipping price for 35 kg (i.e., the higher of the actual weight or the volumetric weight).

In the example above, the return would have cost 200 SEK as the volumetric weight is between 3-50 kg and no single side of the package exceeds 120 cm.

Keep in mind that you are responsible for the shipment until it arrives at us, so pack well protected!

5.3 All goods must be returned in original packaging without damage. Tape and shipping labels may only be attached to the outer packaging. Return slip must be included from the return portal. If the return slip is not filled in correctly, the return slip is missing in the package, or if any of the other criteria above are not met, we reserve the right to make a deduction of 20% of the product's value. From the time you have received the shipping label for your return, the package must be submitted to an agent within 14 days, otherwise the return will not be approved.

5.4 Returns must not be sent cash on delivery or to an agent, packages must also not be sent directly to our business address, returns must go through our system to ensure tracking and correct handling in our systems. If these conditions are not met, the return will not be approved. Orders placed via Hamphi.com (e-commerce) cannot be returned in physical store. All returns of e-commerce orders must be sent back according to the instructions in Hamphi AB's return process. This is because the store and e-commerce are handled in separate systems and logistics flows, which means that the store cannot receive or administer returns of web orders.

5.5 When ordering from North American suppliers or Maxton Design, the right of withdrawal applies (with the exception of special orders), but the goods should not be sent back to us. You are responsible for the shipping back to the manufacturer. Examples of North American suppliers are Unplugged Performance, T-sportline, Rally Armour.

Please be aware that shipping costs for this are usually very high. We can arrange shipping labels within Europe for returns to Maxton Design according to the following price list:

Package with one side not exceeding 120 cm: 1000 SEK
Package with one side exceeding 120 cm but not 150 cm: 1500 SEK
Package with one side exceeding 150 cm but not 180 cm: 2000 SEK
Package with one side exceeding 180 cm but not 200 cm: 2500 SEK
Package with one side exceeding 200 cm but not 300 cm: 3000 SEK

Orders of Maxton Design cannot be canceled after placing the order. If the customer no longer wants the product after ordering, the delivery must first be received, and then returned according to applicable return terms of 14 days, alternatively the customer can refuse the delivery at the time of delivery according to applicable terms and conditions.

5.6 Tesla original spare parts are ordered with a specified VIN number and are therefore custom-made. Right of withdrawal does not apply. Always check that the VIN number is correct before ordering. Return is only approved in case of incorrect delivery or defective goods, in accordance with our return policy.

5.7 If the order is placed with company information (e.g., company name or organization number), it is considered a company order. The right of return does not apply. In case of refused return, return shipping is charged as above. If you want the goods sent back, a new shipping cost is required which will be invoiced and must be paid before shipment.

5.8 Tires do not count as packages and require special delivery. When returning tires, a return cost of 500 SEK per returned tire is charged.

5.9 For purchases from Norway & United Kingdom, the right of withdrawal applies in accordance with consumer protection legislation (Consumer Contracts Regulations). The customer has the right to withdraw from their purchase within 14 days of receiving the goods, with the exception of products that according to law or these terms and conditions are excluded from the right of withdrawal (e.g., special orders).

The customer must always contact Hamphi AB in advance to register the return and receive an approved reference or case number before the return is sent. Returns sent without a valid reference number may be rejected.

For returns from Norway or the United Kingdom, the customer is responsible for:

- return shipping
- customs fees, import VAT and local taxes
- handling and administrative fees from transport companies

Hamphi AB does not act as an importer or customs agent. Returns must be sent trackable and correctly marked as "Return of goods". Any costs incurred by Hamphi AB as a result of incorrect marking, refused delivery, or failure to pay customs will be passed on to the customer or deducted from any refund.

For purchases from countries outside the EU and the United Kingdom, there is no statutory right of withdrawal. Returns from these countries are only accepted after express approval from Hamphi AB.

The customer must always contact Hamphi AB in advance to apply for a return and receive an approved reference or case number before the return is sent. Returns sent without prior approval or without a valid reference number may be rejected.

For approved returns, the customer is responsible for all costs, including but not limited to:

- return shipping
- customs fees
- import VAT and taxes
- handling and administrative fees from transport companies

Hamphi AB does not act as an importer, customs agent, or tax agent. Costs charged to Hamphi AB in connection with returns will be passed on to the customer or deducted from any refund.

Hamphi AB reserves the right to wholly or partially refuse returns from countries outside the EU.


6. Refund

If you have exercised your right of withdrawal and it has been approved, we must refund what you have paid for the goods as soon as possible or at the latest within 30 days from the day we received the goods. We do not refund the shipping cost in your original purchase if you paid for it, as it is a shipping service that has been consumed.


7. Complaint

7.1 Please contact customer service [email protected] before returning an item, regardless of reason, for instructions and the fastest possible handling. According to the Consumer Sales Act, you have the right to complain about your purchase to us within a reasonable time (however, no more than three years). If you want to complain about a product, you must do so within a reasonable time after you noticed or should have noticed the defect by contacting us. The defect should normally be an original defect and not caused by incorrect use/handling of the goods. Complaints made within two months from the time you discovered the defect are always considered to have been made in time.

7.2 To report that an item you ordered from us is defective, we recommend that you contact us via email at [email protected]. Don't forget to include information such as order number and product number/product name. Describe the defect carefully for the fastest possible handling and attach pictures of the defect.

7.3 In many cases, we will need to receive the item back to handle the complaint. In such cases, we recommend that you send the goods in a trackable and insured manner, as you as the sender are responsible for ensuring that the goods have reached us. Normally, the customer initially pays for the return shipping. For approved complaints, the customer is always compensated for the return shipping. It is only for approved complaints that we pay for shipping.

7.4 You as a customer or company must report damaged packages and products on the same day as delivery, this so that you can make a complaint with the shipping company. Hamphi AB does not assume responsibility for warranties that customers lose on their cars when installing various products sold at Hamphi.com. Installation is done at your own risk.

7.5 For approved complaints, we send out new products, if the products are out of stock, we may offer you equivalent products, although to the greatest extent we try to offer the same products again, it is not always possible. When you receive the new products, you also receive a return slip that you can stick on the same package to send the damaged products back to us. If you do not choose to send back the new products, the complaint is not approved in its entirety and we will charge you for the new replacement products we send out as well as the shipping for these.

8. Uncollected Packages

8.1 In connection with uncollected packages, a number of costs arise from shipping companies that we are forced to pay. Therefore, we charge a cost for uncollected packages of 200 SEK in addition to the return shipping. The cost is deducted from any refund.

This cost is added together with the return shipping on the goods depending on its volumetric weight and actual weight. The cost is to cover part of our increased costs from the shipping companies for you not having collected the package you ordered. That is, the handling and administration for the shipping company to start handling a return. Return shipping is added according to the price list above.

This also applies if you as a customer have provided an incorrect phone number in your order so you have not received SMS correctly regarding pickup of your package. Then it is your responsibility as a customer to contact us or the shipping company for your order before the package is returned to us. The amount for uncollected package together with return shipping is deducted from your refund for the order. If the refund amount on the order does not cover this cost, the remaining part will be invoiced externally. If you regret your purchase and do not want to pay this fee, you must pick up the package and then return it to us according to the information found under Right of Withdrawal.

8.2 Packages to be picked up at an agent remain at the agent for up to 14 days (depending on your choice of shipping provider at checkout) before being returned to us. For larger shipments sent on half or full pallets to your company or to your home address (usually tires, rims, etc.), special terms apply, see point 4.7.

8.3 Changes to existing deliveries after the package has left our warehouse are made for a cost of 300 SEK and are invoiced afterwards.

8.4 When choosing pickup in store (Borås), the customer is responsible for picking up their order within 30 days from when the order is marked as ready for pickup and the customer has been notified by email (customer's responsibility to ensure the email is delivered).

If the order is not picked up within this period, Hamphi AB reserves the right to charge a handling fee of 100 SEK to cover costs for administration, storage, and handling.

If the customer wishes to cancel an order that has not been picked up, and the order at the time of cancellation is already picked and packed for pickup, Hamphi AB reserves the right to charge a handling fee of 100 SEK. Any refund is made with a deduction for the applicable fee.

9. Dispute

9.1 We strive to resolve all matters in agreement with the customer before a dispute arises so that you as a customer feel satisfied with your purchase. If you have a complaint or claim against us, we are happy to receive this via our customer service. We ask you in such cases to send an email to [email protected].

9.2 Disputes concerning the application or interpretation of these terms and conditions shall be interpreted in accordance with Swedish law and settled by the General Complaints Board, or ultimately by a general court.

10. Changes to Terms and Conditions

10.1 Hamphi reserves the right to make changes to the terms and conditions. Changes to the terms and conditions will be announced at Hamphi.com. The terms and conditions applicable at any given time are available at Hamphi - terms and conditions

11. Links

11.1 Hamphi.com and Hamphi AB may link to other websites that are outside our control and vice versa. Although we aim to ensure that we only link to such websites that share our policies, Hamphi AB is not responsible for the protection or confidentiality of information including personal data that customers provide on other websites. We recommend that customers read the privacy policy for the relevant website.

12. Installation

12.1 Products installed by you as a customer or at our workshop are not covered by open purchase, as the goods after installation are not in new condition.

12.2 If you as a customer or another third party choose to remove installed products and other technical solutions installed by Hamphi AB, Hamphi AB reserves the right not to reinstall certain parts if they are considered damaged or broken due to being incorrectly removed from the vehicle. In these cases, you are offered spare parts/replacement products at a discounted price to replace the damaged parts. If you as a customer or another third party have chosen to remove any product(s) that Hamphi AB has installed at the customer's request, we reserve the right to charge you as a customer if you wish to have the equipment or products reinstalled.

12.3 Hamphi AB does not assume responsibility for damages that may occur to your or others' vehicles when you install any of our products at your own risk. Any costs associated with installation, incorrect installation, or damage from incorrect installation are the customer's own responsibility.

12.4 Cars brought into the workshop at Hamphi AB are insured against damage that may occur in connection with the installation of various products. For applicable insurance and terms with our respective dealers, we recommend that you contact them directly.

12.5 In case of cancellation of workshop time in its entirety, 10% of the order value is charged as an administrative fee. This is to cover the administrative costs that arise in connection with cancellation of your order in the workshop and changes to prepared products for your installation.

13. Dealer/Partner

13.1 Products from Hamphi.com sold and/or installed by approved dealers for Hamphi AB are under the same warranty and service that we at Hamphi.com offer you. Please note that installed goods are not covered by open purchase, as the goods after installation are not in new condition and packaging is recycled.

13.2 For the right of withdrawal with our respective dealers, we recommend that you contact them directly for applicable terms.

13.3 Hamphi AB offers a partner portal for approved partners. Purchases, commissions, and other terms related to partner activities are regulated through separate partner agreements and partner terms, which are provided in the partner flow. In case of any deviations between these terms and conditions and partner agreement, the partner agreement applies to partner-related purchases and transactions.

14. Cancellation of Rental Agreement

14.1 In case of cancellation of booked equipment, the lessor is entitled to charge compensation according to the following:
– 10% of the rental cost for cancellation occurring more than 30 days before the start of the rental period.
– 50% of the rental cost for cancellation occurring within 30 days but more than 7 days before the start of the rental period.
– 100% of the rental cost for cancellation occurring within 7 days before the start of the rental period.

Other

We reserve the right for any typographical errors and changes to technical data beyond our control. We reserve the right to change prices on products without prior notice.
